Getting Married As A Foreigner In India

I returned to India in July 2022, and my husband and I got married in September 2022. Before coming back, I did extensive research on the requirements for marriage in India. However, we encountered several unexpected steps along the way that weren’t mentioned in my research. I want to share our experience to help others in similar situations be better prepared for the process of obtaining a marriage certificate.

Types of Marriages in India

India recognizes both civil and religious weddings as legally valid. There are three types of marriage licenses available: Hindu, Christian, and Special (for couples of mixed faith). As a foreigner marrying an Indian national, you will need to register your marriage under the Special Marriage Act of 1954.

Special Marriage Act Requirements

Residency Proof for Foreign Nationals

Under the Special Marriage Act of 1954, at least one of the parties must have resided in India for a minimum of 30 days before applying. As a foreigner, I had to prove my 30-day residence with a Form C and a certificate issued by the local police station.

Other Essential Documents

Below, I’ve listed the other required documents.

Using an Agent: Is It Worth It?

Benefits of Hiring an Agent

We hired an agent to assist with the registration process, though it is possible to do it on your own. However, the general consensus is that the process is much smoother with an agent. They are familiar with the system and act as intermediaries, making it easier to navigate the paperwork and avoid unnecessary delays.

Costs Involved

We paid about ₹8,000 for our agent’s assistance, even though we had already gathered all our documents. The agent’s role mainly involved submitting the documents and representing us to the registrar. Unfortunately, these extra steps, often involving additional costs, have become a norm in navigating legal processes in India.

Witness Requirements

You will need two witnesses to finalize the registration. Each witness must provide a copy of their Aadhar card.

The Indian Marriage Registration Process

Step 1: Gather Your Documents

Collect all the necessary paperwork before visiting the marriage registration office.

Step 2: Submit Your Application

Once your documents are approved, a notice of intent to marry is posted at the registrar’s office for 30 days.

Step 3: Issuance of Marriage Certificate

After the 30-day notice period, and if all paperwork is in order, the marriage certificate is issued.

Timing Your Ceremony

Given the uncertainty in processing times, we scheduled our wedding ceremony a few weeks after we expected to receive our marriage certificate. This helped avoid any potential delays that could interfere with our plans. We received our certificate on September 12th and had our ceremony on September 26th. This timing allowed us to hold a separate celebration with vows.

Required Documents Checklist

For the Foreigner

      • Passport
      • Passport-sized photos (rectangular wallet size, not necessarily with a white background). Obtain several copies, as these will be pasted on your marriage certificate.
      • Birth certificate
      • Valid visa (should be valid for at least 30 days). You can marry on a tourist visa. I initially applied for a 10-year visa, which proved unnecessary. After marriage, you can convert to a stay visa. Despite being told that an e-visa couldn’t be converted because it’s marked as “non-extendable and non-convertible,” the same rule applied to the 10-year visa. Once converted, the previous visa becomes invalid, making the 10-year visa a costly and time-consuming choice.
      • Form C: This form registers your place of stay. While hotels typically file Form C for their guests, rental property owners often hesitate to do so. We were able to convince our landlord to file the Form C with the local FRRO since I was staying in a flat connected to my husband’s family. My husband then submitted the Form C to the local police station.
      • Letter of No-Objection or Affidavit of Eligibility to Marry. Both of these confirm oyu are free to marry. However, depending on your circumstances you will need one or the other. If you’ve never been married before then the Letter of No-Objection. If you’ve previously been married you will need the Affidavit of Eligibility to Marry. You can find samples of these documents and further instruction under Sample Documents.
      • Divorce certificate (if applicable)
      • Death certificate (if widowed)

For the Indian National

      • Birth certificate or Marks Card
      • Aadhar card
      • Passport (if available)
      • Proof of residence (e.g., a lease agreement)
      • Passport-sized photos (same requirements as above)

For the Witnesses

      • Aadhar Card (original and copies)

After Marriage: Visa Conversion and OCI Application

Applying for an X-1 Entry Visa

After marriage, you can apply to convert your visa to an X-1 Entry visa, allowing you to stay in India with your spouse without needing to leave the country.

Eligibility for an OCI Card

After two years of marriage, you become eligible to apply for an OCI card (Overseas Citizen of India), which grants additional residency rights.
